A jury found Bennie Lee Moore guilty of aggravated robbery and, after finding the enhancement allegations to be true, assessed punishment at fifty years. In seven points of error, Moore contends that: (a) the evidence was insufficient to support the verdict; (b) the trial court failed to properly instruct the jury on what constitutes serious bodily injury; (c) the trial count erred in overruling his motion to quash the indictment; (d) the trial court erred in overruling his motion to appoint an expert witness; (e) the trial court improperly admitted certain statements he made to the security guards; and (f) the evidence was insufficient to support the jurys finding of true to the enhancement allegations. We find no merit in the first six points of error; however, we agree that the evidence was insufficient to support the finding of true to the enhancement allegations. Thus, we sustain the seventh point of error. The conviction is affirmed, the judgment is reversed, and the cause is remanded to the trial court for further proceedings consistent with this opinion.
